Nonverbal Behaviour Therapeutic Index (NBTI) — Hybrid Online Course
1About these terms
1.1 These terms and conditions ("Terms") govern your enrolment on the Nonverbal Behaviour Therapeutic Index hybrid online course (the "Course") provided by Nonverbal ACEs Ltd, a company registered in England and Wales (company number 16993339) with its registered office at 48 King Street, Kings Lynn, PE30 1HE ("Nonverbal ACEs", "we", "us", "our").
1.2 By enrolling on the Course you ("you", "your", the "Participant") agree to be bound by these Terms.
1.3 Professional purchasers. These Terms are primarily designed for and directed at mental health and coaching professionals purchasing the Course for continuing professional development ("CPD") in a professional or business capacity. Where you are purchasing in such a capacity, you confirm that you are doing so for the purposes of your trade, profession, or CPD.
Where applicable consumer protection legislation applies to your purchase (for example, if you are an individual purchasing otherwise than in a business capacity), nothing in these Terms limits or excludes any rights you have under that legislation, including under the Consumer Rights Act 2015 or the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.

2The course
2.1 The Course comprises:
- access to the Online Learning Portal containing course modules, videos, and supporting materials; and
- twelve (12) weekly live group calls hosted by Nonverbal ACEs.
2.2 The Course is intended for mental health and coaching professionals as continuing professional development (CPD).
2.3 On successful completion you will receive a certificate confirming 25 CPD hours, subject to meeting the completion criteria notified at enrolment.
3Enrolment
3.1 Enrolment is completed when you submit payment (or the first instalment) via our payment provider and we issue confirmation of enrolment by email.
3.2 Cohort places are limited and allocated on a first-come, first-served basis.
3.3 You must provide accurate and current contact information at enrolment and notify us promptly of any changes.
4Fees and payment
4.1 The standard Course fee is £2,500, payable as:
- a one-off payment of £2,500; or
- three monthly instalments of £900 (total £2,700).
4.2 Where a valid discount coupon is applied, the Course fee is £2,000, payable as:
- a one-off payment of £2,000; or
- three monthly instalments of £733 (total £2,199).
4.3 All payments are processed via PayFunnels. By submitting payment, you authorise the relevant charges and instalments.
4.4 If an instalment payment fails or is missed:
- your access to the Online Learning Portal will be paused immediately;
- you will not be admitted to live group calls;
- access will be reinstated on receipt of the outstanding payment.
4.5 VAT. Nonverbal ACEs Ltd is not currently registered for VAT. All fees shown are the total amount payable. We will notify you of any change in our VAT status that affects the fees quoted to you.
4.6 Enrolment and Course fees are personal to you and may not be transferred to another individual.
5Access to the Online Learning Portal
5.1 You will receive access to the Online Learning Portal for twelve (12) months from the start date of your enrolled cohort. Access is not counted from your enrolment date.
5.2 Access is granted to you personally. You may not share login credentials, allow access by any third party, or provide access to multiple users from a single account.
5.3 We may suspend or terminate your access if we have reasonable grounds to believe these Terms have been breached.
6Live group calls
6.1 The Course includes twelve (12) weekly live group calls scheduled at fixed times notified at the start of your cohort.
6.2 Recording of live calls. Live calls are recorded and uploaded to the Online Learning Portal so Participants can review any sessions they are unable to attend live. By enrolling on the Course, you acknowledge and accept that:
- live calls will be recorded (audio and video);
- recordings will be made available to other enrolled Participants in the same cohort via the Online Learning Portal;
- recordings will be used solely for the purpose of cohort access and will not be shared externally or used for any other purpose.
6.3 You may turn off your camera and/or microphone at any time during a live call if you do not wish to appear on the recording. If you have a specific concern about recording, please contact us at info@nonverbalaces.com before your cohort start date.
6.4 Recordings are made available on a streaming-only basis. Downloading, copying, screen-recording, redistributing, or otherwise reproducing recordings is strictly prohibited.
6.5 Participants must anonymise any case examples shared during live calls. Specific identifying personal information about clients or third parties must not be disclosed.
6.6 Recordings will remain available for the duration of your Online Learning Portal access (see clause 5.1). After this period, recordings will be deleted and will no longer be accessible.
7Cohort start dates and deferrals
7.1 Cohorts run on fixed start dates notified at the point of enrolment.
7.2 You may defer your place to the next available cohort, provided you notify us in writing by email at least 7 days before your original cohort start date. One free deferral per Participant is permitted.
7.3 After the 7-day pre-start window, deferral requests are at our sole discretion and may be refused.
7.4 If you do not attend your enrolled (or deferred) cohort, your place is forfeited and no refund will be made.
7.5 Fees paid remain due in full where a deferral is granted.
8Refunds and cancellation
8.1 You may cancel your enrolment and request a full refund within 14 days of your enrolment confirmation date, by emailing info@nonverbalaces.com.
8.2 After the 14-day window has expired, no refunds will be made, except in the exceptional circumstances described in clause 8.3 or as required by applicable law.
8.3 If you would like to discuss your circumstances, please contact us at info@nonverbalaces.com. We will consider exceptional cases on a discretionary basis.
8.4 Approved refunds will be processed via the original payment method within 14 days of approval.
9Intellectual property
9.1 All course materials — including videos, slides, the Online Learning Portal contents, written documents, recordings, frameworks, models (including the Nonverbal Behaviour Therapeutic Index, the Nonverbal ACEs model, and the ONCE technique), assessments, and supporting materials (collectively, the "Course Materials") — are the intellectual property of Nonverbal ACEs Ltd or its licensors.
9.2 Subject to your continued compliance with these Terms, we grant you a non-exclusive, non-transferable, revocable licence to access and use the Course Materials for your own personal professional development only.
9.3 You may not:
- reproduce, copy, distribute, publish, or republish any Course Material;
- record, screen-capture, or download live calls or portal content;
- share login credentials or Course Materials with any third party;
- use Course Materials to create competing training, derivative works, or commercial offerings;
- remove or obscure any branding, copyright, or proprietary notices.
9.4 Nothing in these Terms restricts you from applying the knowledge and skills you acquire on the Course in your own professional practice.
10Participant conduct
10.1 You agree to participate respectfully and professionally, and in accordance with the ethical standards of your professional body.
10.2 We reserve the right to remove a Participant from the Course, without refund, for behaviour that we reasonably determine to be abusive, discriminatory, disruptive, harassing, or in serious breach of these Terms.
11Confidentiality
11.1 The Course environment is confidential. You agree not to disclose outside the cohort any personal information, professional disclosures, or case discussion shared by other Participants.
11.2 Case material discussed during live calls must be anonymised. Specific identifying personal information about clients or third parties must not be shared.
12Scope of the course — important disclaimer
12.1 The Course is provided for educational and continuing professional development purposes only.
12.2 The Course does not:
- constitute clinical supervision;
- extend, alter, or confer any addition to your existing scope of practice;
- confer any professional licence, accreditation, or qualification beyond the stated CPD hours;
- replace the standards, ethics, or practice requirements of your professional or regulatory body.
12.3 You remain solely responsible for ensuring that your application of any material from the Course is consistent with your training, competence, scope of practice, and the ethical and regulatory standards of your professional body.
12.4 Nothing on the Course constitutes clinical, medical, legal, or financial advice.
13Data protection
13.1 We process personal data in accordance with the UK GDPR and the Data Protection Act 2018. Please refer to our Privacy Policy at nonverbalaces.com/privacy-policy for details of how we collect, use, and retain personal data, including your rights as a data subject.
13.2 In particular, please note that live group calls are recorded (see clause 6.2). Personal data captured in recordings (including your name, voice, and image) is processed on the basis of contract performance and handled in accordance with our Privacy Policy.
14Limitation of liability
14.1 Nothing in these Terms limits or excludes our liability for:
- death or personal injury caused by our negligence;
- fraud or fraudulent misrepresentation;
- any other liability that cannot lawfully be limited or excluded.
14.2 Subject to clause 14.1, our total aggregate liability to you arising out of or in connection with these Terms or the Course shall be limited to the total Course fees actually paid by you to us.
14.3 Subject to clause 14.1, we shall not be liable for any:
- loss of profits;
- loss of business, revenue, clients, or anticipated savings;
- loss of goodwill or reputation;
- business interruption;
- indirect, consequential, or special losses,
howsoever arising.
15Changes and cancellation by us
15.1 We may make reasonable changes to Course content, scheduling, delivery format, or presenters, provided such changes do not materially diminish the overall quality or scope of the Course.
15.2 Where a change is material, we will give you reasonable notice and, where appropriate, the option to defer to a future cohort.
15.3 If we are unable to deliver the Course or any material part of it, we will offer you (a) a place on the next available cohort, or (b) a pro-rata refund of fees paid in respect of any portion of the Course not delivered.
16Force majeure
16.1 We are not liable for any failure or delay in performing our obligations under these Terms caused by events outside our reasonable control, including (without limitation) acts of God, government action, pandemic, war, civil unrest, or internet infrastructure outages. For the avoidance of doubt, failure of a specific third-party software service (such as a course delivery or video platform) shall only constitute force majeure where the failure is sustained and not remediable within a commercially reasonable timeframe by switching to an alternative provider or approach.
17Termination
17.1 We may terminate your enrolment with immediate effect on written notice if you materially breach these Terms and (where capable of remedy) fail to remedy the breach within 14 days of written notice.
17.2 On termination, your access to the Online Learning Portal and live calls will end immediately. No refund will be due where termination is for your breach.
18Complaints
18.1 If you have a complaint about the Course or any aspect of our service, please email info@nonverbalaces.com setting out the nature of the complaint.
18.2 We will acknowledge your complaint within 5 working days and aim to provide a substantive response within 20 working days.
18.3 If your complaint is not resolved to your satisfaction, you may wish to seek independent mediation or, where applicable, contact the relevant professional body or ombudsman.
19General
19.1 Entire agreement. These Terms, together with our Privacy Policy and any document expressly incorporated by reference, constitute the entire agreement between you and us in relation to the Course.
19.2 Severability. If any provision of these Terms is held to be unlawful or unenforceable, the remaining provisions remain in full force and effect.
19.3 No waiver. Failure to enforce any provision is not a waiver of our right to enforce it later.
19.4 Assignment. You may not assign or transfer your rights under these Terms. We may assign our rights and obligations on written notice to you.
19.5 Third party rights. No person other than the parties has any rights under these Terms under the Contracts (Rights of Third Parties) Act 1999.
19.6 Notices. Notices must be sent by email to info@nonverbalaces.com (to us) or to your registered email address (to you).
19.7 Governing law and jurisdiction. These Terms are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction over any dispute arising out of or in connection with these Terms.
By proceeding with enrolment, you confirm that you have read, understood, and agreed to these Terms.
